Child Care Regulation must make annual updates to the criminal history charts that list the offenses and required actions for criminal history results for persons requiring background checks in child care operations.

The updated Criminal History Convictions and Requirements Charts were published in the Texas Register and are effective April 3, 2020.

Non-substantive changes include the following:

  • Updating the Table of Contents and Headings
  • Changing references to “Title 40” to “Title 26” and removing a footnote that referenced the same
  • Correcting previously inaccurate references to 42 USC 9858f.658H in footnotes on the Licensed or Certified Child Care Operations: Criminal History Requirements and the Registered Child Care Homes and Listed Family Homes: Criminal History Requirements charts;
  • Changing the charts as summarized below. See links for additional information:

Substantive changes include:

  • Modifying actions required for certain crimes previously included in the charts:
    • Texas Penal Code
      • 43.02 Prostitution: Changed action and presence for Licensed or Certified Child Care Operations: Criminal History Requirements, and Registered Child Care Homes and Listed Family Homes: Criminal History Requirements
      • 43.03 Promotion of Prostitution: Changed action and presence for Licensed or Certified Child Care Operations: Criminal History Requirements, and Registered Child Care Homes, and Listed Family Homes: Criminal History Requirements
